Terms and
Conditions...
1. In these Terms and Conditions you are hereinafter
referred to as the CLIENT and R & M Discos is hereinafter called R & M.
The CLIENT engages with R & M, and R & M accepts the engagement to appear
at the venue on the date and at the times shown in the Booking Form subject to these
Terms and Conditions.
2. A non refundable booking deposit, of the
amount specified in the Booking Form, must be submitted with the signed copy of
the Booking Form. The booking becomes officially confirmed once the reservation
form (deposit) has been obtained.
3. The balance of the booking fee, as specified
on the Booking Form, should be paid by cash. Under no circumstances will the company
begin rendering services until the balance is paid in full.
4. The total fee quoted is in respect of the
performance during the times specified in the Booking Form. If the client requests
that the performance be extended on the night of the event, then the additional
period and fee must be negotiated with the Disc Jockey provided by R & M, and
paid in cash prior to start of the extension period.
5. In the event of cancellation of the engagement
by the Client, a cancellation fee will be made on the following basis: i) Cancellation
advised in writing, received more the 30 days before the event date - loss of deposit
only. ii) Cancellation advised less than 30 days of the event date will lead to
50% becoming payable immediately. iii) Cancellation advised within 14 days of the
event will lead to the full amount being made payable. Due to the exceptional nature
of Christmas Eve and New Years Eve, these time limits are extended to 60 days.
6. When a booking has been formally cancelled,
and that cancellation has been accepted by both parties, the Client forfeits any
rights to use the services of R & M on that date, irrespective of deposits or
cancellation fees paid.
7. The client must ensure that the Disc Jockey
has access to 2 x 13 amp 240v sockets. The Disc Jockey reserves the right to discontinue
all or part of the equipment if the power provided is not capable of operating the
equipment without risk of damage to the equipment, company or the public or if the
working environment constitutes a health and safety risk. The Disc Jockeys working
position must not block any emergency routes, and must allow space for the Disc
Jockey to operate in comfort and safety. The equipment should not be placed on the
dance floor to avoid damage. If services must be discontinued for any of the aforementioned
reasons, no refund will be awarded.
8. R & M does not tolerate any violent,
aggressive or abusive behavior from anyone. We reserve the right to terminate our
services at any time should we feel our personal safety or the safety of the equipment
is under threat. If this occurs, no refund of any fees will be given and we reserve
the right to claim damages against any person(s) in addition to point 9.
9. The client is responsible for the behavior
of his/her clients or guests and for safeguarding the Disc Jockey and equipment
against theft, damage or other risks, from the moment of arrival to the moment of
final departure. Please note any loss of or damage to equipment, other than that
caused by wear and tear, will be charged for.
10. R & M cannot be held responsible for
the way some people may be affected by lighting / strobe lighting, sound or haze
that may be used during the performance. The client must advise the Disc Jockey
prior to the start of the performance if any effect should be avoided.
11. The Disc Jockey shall be deemed under the
direction and control of the client, and shall be regarded as an agent for the client.
12. The Disc Jockey provided will generally
be an employee of R & M, or a self employed Disc Jockey working exclusively
for R & M. R & M reserves the right however to assign the engagement to
a suitably experienced and qualified associate.
13. The Client will be held responsible for
obtaining all necessary licence and permission relating to the performance at the
event.
14. R & M operates regularly serviced and
maintain good quality sound and lighting equipment.. In the rare event of any equipment
failure, an onsite repair will be attempted. If however the problem is irreparable,
then the on call engineer will be called out(dependant on time) - Should time be
lost during this operation then a refund may be given.
15. R & M shall be entitled to terminate
the contract without liability if for any reason beyond its control the Disc Jockey
is unable to perform, due to theft or fire of equipment, illness or breakdown of
vehicle. R & M will however endeavour to find a replacement Disc Jockey, but,
in the unlikely event of a non performance all refundable monies paid will be refunded
(non refundable deposits are not refundable in any situation) but this will be the
limited of our liability to you.
16. Any breach of these conditions may result
in the R & M staff ceasing performance before the alloted time without recompense
to the client.
Extra Terms for Minors
1. The client will provide adequate adult supervision
of the children attending the event.
2. The supervising adults will provide the Disc
Jockey with assistance in the organisation of the children during any games played
at the event.
3. The supervising adults will ensure that the
children do not interfere with the disco equipment or prevent the Disc Jockey from
performing.
